Termination of Doula and/or Birth Photography
This Termination of Services Contract (“Termination”) between the undersigned parties signifies that both client and contractor involved in the birth photography and doula contract dated “Monday, June 22, 2020” agree to the cessation of that contract due to the client requesting to be released from services.
All services rendered up to this point are considered complete, and the retainer paid to the photographer is non-refundable. A refund amount of $343.75 along with full maternity gallery download Valued at an additional $340 has been agreed upon as the cancellation was requested by the client between 30-37 weeks gestation and will be completed within 48 hours of this agreement being signed. Client has read and agrees to the terms laid out above and affirms that no further services are required past this point in time from the Photo Doula nor monies to be paid from the client.
Client affirms that the Photo Doula will not attend client’s birth.
For and in consideration of the promises and covenants contained in this Termination, the parties mutually release, waive, covenant not to sue, and forever discharge each other from any and all liabilities, claims, and obligations related in any way to the previously signed contract except as may be contained in this Termination, whether known or unknown, which existed, arose, or occurred at any time prior to the date of this Termination
The parties agree that each shall not, at any time after the date of this Termination reveal, report, publish, transfer, or otherwise disclose to any person or entity any information related to: (i) any information disclosed during the cancellation process (ii) the existence of this Termination.
The Client agrees not to attack/criticize Photo Doula or Taryn Starkey and any of it’s associates publicly (on public forums, blogs, social networks etc) at any time during or subsequent to the contract period. Similarly, the client agrees not to seek for seo advice on seo forums, blogs, community groups or any social media in a way that brings bad name to the company or any of its employee, associate or partner. In case of breach of this clause, client agrees to pay in damages to Photo Doula deemed appropriate by Oklahoma State court of law.
